人權(quán)與國際知識產(chǎn)權(quán)保護
摘 要
與貿(mào)易有關(guān)的知識產(chǎn)權(quán)協(xié)議的產(chǎn)生，在促進知識產(chǎn)權(quán)國際保護發(fā)展的同時，也造成了知識產(chǎn)權(quán)制度與國際人權(quán)法之間的沖突。從立法宗旨上講，不管對知識產(chǎn)權(quán)采用什么樣的措辭，知識產(chǎn)權(quán)保護應(yīng)與維護人類尊嚴(yán)和實現(xiàn)其他人權(quán)相1致。因此，我們必須開展有關(guān)研究工作，探尋如何在包括TRIPS在內(nèi)的國際條約框架下，協(xié)調(diào)好知識產(chǎn)權(quán)與人權(quán)之間的沖突---價值連帶和制度互動的問題。具體說來說，知識產(chǎn)權(quán)國際保護制度必須以國際人權(quán)公約的價值取向為指導(dǎo)，在保護公共健康權(quán)、隱私權(quán)等方面進行制度改革。

ABSTRACT
The emergence of TRIPS is thought to promote the international protection of intellectual property while engender the conflicts between intellectual property system and internatinal human rights law.From the tenet of legislation,regardless of any experssions being used to intellectual property, the protection of intellectual property should be accorded with the protection of human dignity and realization of other human rights.Consequently, we must develop related research work to search how to harmonize the relationship between intellectual property and human rights under the framework of international treaties included in TRIPS---the problem of related value and mutual system.In details,the system of international protection of intellectual property must make public health,privacy,etc. under the direction of the value orientation of international pacts concerning human rights.
