審前準(zhǔn)備程序初探

摘  要
  
    審前準(zhǔn)備是審判程序中的1個(gè)相對(duì)獨(dú)立的訴訟程序階段，有其獨(dú)立的價(jià)值。該程序階段完結(jié)有其相應(yīng)的訴訟法律后果，對(duì)后來(lái)的判決結(jié)果有重要影響，審前準(zhǔn)備內(nèi)含著整理案件爭(zhēng)點(diǎn)、固定案件證據(jù)、保障開(kāi)庭審判、提高庭審效率等功能，但從立法和司法的現(xiàn)狀看來(lái)，該程序所存在的缺陷也是不容忽視的，因此應(yīng)對(duì)審前準(zhǔn)備程序給予特別關(guān)注，就與之相關(guān)的若干問(wèn)題展開(kāi)論述。

ABSTRACT

The civil pre-trial preparation procedure is a relative independent course in a unitary litigation. It has its own value and litigation results. The civil pre-trial preparation produce has the function of regulating disputation, fixing evidence, guaranteeing hearings and enhancing the efficiency of a case. But from the present situation of legislation and jurisdiction, it also has some flaw. So it is very important to pay close attention to the civil pre-trial preparation procedure and make expound of it.
