終止解除勞動合同證明書

終止解除勞動合同證明書

　　一、本人原因解除勞動合同：

　　1、本人提出要求，經雙方協商一致解除勞動合同;

　　2、勞動者提前30日或在試用期內提前3日以書面形式通知用人單位解除勞動合同。

　　二、非本人原因解除、終止勞動合同：

　　1、單位要求并與勞動者協商一致解除勞動合同;

　　2、(1)符合《勞動合同法》第38條第1款第項、(2)第2款由勞動者解除勞動合同;3、符合《勞動合同法》第39條第項由單位解除勞動合同;

　　4、符合《勞動合同法》第40條第項由單位解除勞動合同;

　　5、符合《勞動合同法》第41條第1款第項終止解除勞動合同;

　　6、符合《勞動合同法》第44條第項終止勞動合同。
